  1. Privacy Statement

In this privacy statement “YMF”, “we”, “us” and “ours” means Yamaha Motor Finance Australia Pty. Ltd. ACN 101 928 670. YMF is a wholly owned subsidiary of Yamaha Motor Australia Pty. Ltd. ACN 002 556 989 (“YMA”) and part of YMA and its related bodies corporate (“the Yamaha Group”). We have built the customer mobile application (“Application”) as a service to better assist our customers.

This privacy statement is to inform you about our policies regarding the collection, use, and disclosure of your personal information if you use our Application.  It also provides the key features of our privacy policy and is to be read in conjunction with it, which is available at: https://www.yamaha-motor.com.au/privacy/policies/ymf-australia-privacy-policy (“Privacy Policy”).

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles upon which this privacy statement is based.

  1. What information is collected and why

Our Privacy Policy sets out what information we collect and why.  In summary, we collect your personal information so that we may provide, improve, and administer our products and services including the Application as well as deal with any disputes or complaints. We may collect information including, inter alia, your name, identity details, photos, contact details and address. Our Privacy Policy sets out the personal information we usually collect together with further reasons why we collect it in more detail. Furthermore, for a better experience, while using our Application, we may collect certain personal identifiable information from you, including but not limited to your device identification.  We may also collect:

Log Data

In case of an error in the Application, we collect data and information (through third party service providers) on your mobile device called Log Data. Log Data may include information such as your device internet protocol (“IP”) address, device name, operating system version, the configuration of the Application when utilising our Application, the time and date of your use of the Application, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

Our Application does not use these “cookies” explicitly. However, the Application may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse these cookies, you may not be able to use some portions of the Application.

  1. How we collect your information

Our Privacy Policy sets out how we will collect your information.  In summary, we will collect your personal information from you directly wherever we can, including where you use our Application.

If we are unable to collect your personal information, we may not be able to provide you with our Application or you may not be able to operate the Application in full.

These third-party services as well as their websites are not operated by us. Therefore, we strongly advise you to review the privacy policies of these third-party service providers. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

  1. How we handle your information

Our Privacy Policy spells out more explicitly how we will use and disclose your information. In summary, we will use your information to facilitate your use of the Application, and for other purposes including preventing, detecting or investigating fraud or crime or any suspected fraud or crime, identifying opportunities to improve our services to you, as required by law, regulation or codes binding us and for any purpose to which you have given your consent.  We will use and disclose your information for the reasons we collect it and for other reasons that are directly related, where you would reasonably expect us to.

We may share your personal information with other organisations for any of the purposes which we collect your information, including to the Yamaha Group, unless you tell us not to. You can do this by using the details described in “Contact Us” below.  Where you ask us not to share your information with other organisations (including to the Yamaha Group), we may not be able to provide you use of the Application.  Our Privacy Policy sets out exactly who may share your personal information with. We may also share your information with third-party companies that are not related to YMF, such as service providers.

  1. Overseas disclosure

In certain situations we may need to provide your personal information to – or get personal information about you from persons located overseas for the same purposes set out in ‘What information is collected and why’ and as expanded on in our Privacy Policy.  Countries we may disclose your information to include India, Japan, New Zealand, Singapore, and the Philippines.

Our Application has a function allowing you to use your mobile device’s camera to take pictures and scan barcodes only.  Where you choose to use this function, we will only collect information relating to the specific picture or barcode.

Our Privacy Policy contains information about how you may access and seek correction of the personal information we hold about you. In summary, you may gain access to your personal information by using the contact details described in ‘Contact Us’ below. We will correct inaccurate personal information within 30 days of a correction request and will send written notice confirming the correction within a reasonable period. In the event information was previously disclosed to another entity or third party, we will take reasonable steps to notify them.

YMF may charge an access fee to cover the cost of staff searching for, locating, retrieving the requested information and staff reproducing and sending it to the person (postage or using an intermediary) who has requested access.

Access to personal information may be refused in several circumstances, such as where the information relates to anticipated legal proceedings or the request for access is frivolous or vexatious. If we deny or restrict an individual's access, we will write to you explaining why access was refused or restricted.

In summary, we and other entities in the Yamaha Group might let you know about news, special offers, products, and services that you might be interested in and will engage in marketing unless you tell us otherwise. If you believe the privacy of your personal information has been compromised, our Privacy Policy contains information about how you may raise a complaint and how we will deal with such a complaint.

We may update our Privacy Policy from time to time. You are advised to review our website periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on our website. Any changes to our Privacy Policy will be effective immediately after it is posted on our website.
